2. The legal entitlement to the provision of medical aids

The legal basis for the provision of medical aids is extensive, but we make it easy for you to understand the most important information. The central paragraph that is relevant for you can be found in the Fifth Book of the German Social Code (SGB V), more precisely in § 33. This paragraph specifies when you are entitled to medical aids. You can apply for medical aids if they

  • ensure the success of your medical treatment,
  • prevent impending disabilities or
  • compensate for existing disabilities.

It is important that the aid helps you in the specific case to reduce or eliminate the negative effects of your disability. This can also mean that the aid makes it easier for other people to care for you.

3. Groundbreaking BSG rulings

There are several important rulings by the Federal Social Court (BSG) that are relevant to the provision of medical aids in practice. These rulings clarify which medical aids are considered necessary and how health insurance companies must assess applications. We take a look at some of these landmark rulings and explain what they mean for your application.

Landmark rulings by the Federal Social Court (BSG) have made a significant contribution to clarifying entitlements to medical aids. In particular, it emphasizes that assistive products can also be necessary if they are not only used by the insured person, but also to facilitate care by third parties.

The BSG's decision that the provision of medical aids can also apply to non-medical aids shows that the need must be assessed on an individual basis. This has far-reaching consequences for the practice of applying for aids and their approval by health insurance companies.

4. Case study 1 - direct authorization

In this section, we present an example in which a medical aid was successfully and directly approved. We show how the application was made, what documents were required and what role communication with the treating doctor and the health insurance company played. This example is intended to show you what a smooth process can look like and what you should bear in mind.

5. Case study 2 - Rejection and objection

The approval process is not always without obstacles. In this chapter, we present an example in which an application was rejected in the first step. We explain the reasons for the rejection and show how the appeal was successfully submitted. This case study should help you to be better prepared for possible difficulties and to understand what steps you can take if your application is rejected.

Do not be discouraged by a rejection! You have the right to appeal against the decision.

6. medical aids in nursing homes

Residents of nursing homes are entitled to the provision of aids in the event of illness . If an aid serves to fulfill individual basic needs, it does not fall under the obligation of the nursing homes to provide it, but under the obligation of the health insurance company to provide benefits. This includes

  • Individually adapted aids that are specifically intended for the individual resident and may only be used by them.
  • Aids that are used to satisfy general basic needs outside the care home.

Examples include activities such as walks in the fresh air or outings with relatives and friends. The entitlement to aids such as an electric add-on drive or a pushing and braking aid also exists during a stay in a care home.

7. application as a nursing aid

In principle, mobile stair climbing aids can also be classified under long-term care insurance. The provisions of Section 40 SGB XI (the law governing statutory long-term care insurance) regulate the entitlement to care aids and measures to improve the living environment.

The prerequisite is that the person in question is in need of care. This is usually proven by the corresponding care level.

Since the provision of a care aid is always subordinate to the provision of the aid by the health insurance fund, the latter must first check whether there is a claim under health insurance law in accordance with § 33 SGB V - only then can a claim for a care aid be considered.
